MOSEEKER, INC. and/or our affiliates incorporated in People’s Republic of China (hereinafter referred to as “we” or “MoSeeker”) value and protect users’ (hereinafter referred to as “you”) personal information. We will process (include collection, storage, use, processing, transmission, provision, disclosure etc)and protect your personal information as described in this Personal Information Protection Policy (hereinafter referred to as this “Policy”) when you use our product and service. This Policy informs you of how we process your personal information and the ways provided by us to facilitate you to access, update, delete and protect your personal information. This Policy applies to mobile recruitment products and services of MoSeeker, including products and services which are provided by our affiliates (as defined in Definitions) without independent personal information protection policy.

DEFINITIONS

1. MoSeeker means MOSEEKER, INC. or its affiliates incorporated in People’s Republic of China.
2. MoSeeker Mobile Recruitment Platform means a website with domain name of moseeker.com.
3. Personal Information means all kinds of information related to identified or identifiable natural persons recorded in electronic or other form, excluding the information processed anonymously .
4. Sensitive Information means personal information that is likely to result in damage to the personal dignity of any natural person or damage to his or her personal or property safety once it is divulged or illegally used, including such information as biometric identification, religious belief, specific identity, medical health, financial account and whereabouts and tracks, as well as the personal information of minors under the age of 14 (if involved).
5. Deletion of Personal Information means to erase personal information from system involved in daily operation and keep the erased information unsearchable and inaccessible.
6. Affiliates means any entity directly or indirectly controlling or controlled by or in common control with MoSeeker.

HOW WE COLLECT AND USE YOUR PERSONAL INFORMATION

We collect and use your personal information fora definite and reasonable purpose which is necessary to operate the frature of our product/ services under the principals of lawful, legitimate, and necessary.
1. Situations in which collecting and using your personal information is necessary
Our products and services contain some core functions including the functionality necessary to provide MoSeeker Mobile Recruitment technical service, the functionality necessary to improve our products and services and the functionality necessary to secure transactions. We may collect, store, and use the following information about you to achieve functions hereunder. If you do not provide relevant information, you will not be able to enjoy the products and services we provide. The abovementioned functions and the necessary information for them include:
1.1. the functionality necessary to provide MoSeeker Mobile Recruitment technical service
(1) Registering to be user
It is necessary for you to register a user account in order to use our service. To create an account you need to provide data including your name, email address, mobile number, a username and a password (but we do not collect and store any of your password) at least. We will authenticate your identity validity by sending a verification code to your mobile phone or mailbox. If you do not provide abovementioned information, you cannot register to be our user, but you can use our basic service including browsing and searching. Besides, if necessary, we may have to need you to provide your ID. Card number to meet the policy of Real-name certification under laws ,regulations, and order of regulators.
You may use our products and services by login the account of third-parties who cooperating with us. In this situation,we may collect your information provided to the third party, such as account name, network name etc.. Please carefully read the login notice when you login.
If you use the function of one-click login or one-click register, we will collect your mobile number from operators such as China Mobile, China Unicom or China Telecom (hereinafter refer to as “operators”) (or from the entities authorized by operators). The purpose of to collect information is allow you conveniently login the account rather than manually input the phone number and password. Only if you agree the agreement on certification services for operators, can we collect these information. We can only provide you conveniently login, account registering and further services.
During the period you using our service, you continuously authorize us to use the abovementioned information. We will delete or anonymize the abovementioned information as soon as possible according to applicable laws while you close your account.
(2) Providing recruitment service
Usually, we will collect your basic information (such as name, gender, date of birth), contact information (such as mobile phone number, email address, address), employment record (such as work experience, work seniority, work base, expected position, expected work base), education background (education record, years and dates of schooling, degrees, academic credits) and other necessary multimedia resume information to provide recruitment service including recommending jobs to you and you to recruiters.
Upon your consent, your resume can be found from our database by your designated employers and their authorized recruiters that purchased recruitment service from MoSeeker. It will be deemed that you agree to provide your resume to your designated employers and their authorized recruiters that purchased recruitment service from MoSeeker and you allow them to browse and use your resume for reasonable recruitment purposes if you provide to or allow MoSeeker to take your resume from any other third-party recruitment service provider. MoSeeker shall not be liable for any dispute arising from their use of your information, including and not limited to any misuse or illegally use by employers and their recruiters.
(3) Product and service demonstration, personalized recommendation, promotional message sending
In order to show or facilitate your searching of our product or service, or to recommend personalized job opportunities, we will collect your information including but not limited to your device information (including device name, type, device identifier, operating system or application version, language, resolution, network ID of network service provider, web browser type), personal browsing records and log information (including IP address, web browser type, telecommunication operators, language, accessing date and time, searching and browsing records, application using records, clicking history, operation log), location information, and extract your demographic information including but not limited to browsing and searching preference, behavioral habit and location based on the abovementioned information, to show and push message to you based on feature tags and indirect users profiling. If you don’t want to receive our pushing, you can unsubscribe it by sending E-mail to ask@moseeker.net.
Please be aware that the abovementioned information like device information, log information cannot be used independently to identify you so they are not personal information and we have right to use them based on lawful purpose. Only in the case that your device information and log information are combined with other identifiable information of you and the combined information can be used independently to identify you, the combined information will be deemed as personal information. Unless we have your separate authorization or otherwise stipulated by law, we will anonymize and de-identify the combined personal information and process, protect them as well as your other personal information pursuant to this Policy.
(4) Customer service
Our customer service will use your account information when you need customer service in your use of our product and service. You may provide more information than the aforesaid when you communicate with our customer service representative (hereinafter referred to as “CSR”). Except for the necessary information related to the problem or service you asking (such as your account name), Our CSR will not request you to provide other irrelevant information (such as your password). We will record interaction process between you and our CSR by system log and delete or anonymize your personal sensitive information from our interaction log after the expire of minimum storage period as stipulated by laws and administrative regulations and the end of customer service or completion of your demand pursuant to the laws and supervision requirements.
1.2.Improve the functionality necessary for our products and/or services
In order to improve and optimize our products, services and functions, we may use information collected from your device to provide service, personalized content and advice to you.
2 Situations in which you may decide whether to authorized us to collect and use your personal information
To improve your experience on using our product and service, we may collect and use your personal information in our auxiliary functions hereinafter.
If you do not provide the following information, you may still use the basic functions of our product and service, but the relevant auxiliary functions may not available for you to improve your experience or you have to provide some information repeatedly when you use relevant product or service. The auxiliary functions include:
2.1. Personalized recommendation based on location information: we will collect your location information (we will collect your temporal location information but we will not combine your temporal locations to track you) to detect your location to recommend suitable jobs or other service in your area automatically. If you choose to close this function, an accurate message pushing may not be available.
2.2. Auxiliary functions based on the camera: you may use this function to make video and photo, scan a QR code, face recognition and other similar functions. When your log in your account through face recognition, we will collect your facial information. If you choose to close this function, videos transmitting may not be available for you when you use our service.
2.3. Auxiliary functions based on microphone and voice: you may use microphone to carry out voice communication or speak, interact with to our CSR. We will collect your voice content to recognize your demand when you use this function. If you choose to close this function, the aforesaid service may not be available for you.
2.4. Auxiliary functions based on mobile phone contacts: we will collect your mobile phone contacts so that you need not input your contacts manually when you use our product or service. If you choose to close this function, the aforesaid service may not be available for you.
2.5. Auxiliary functions based on notification: we will use the notification function of your device to send various message in connection with our product and service. You need to authorize us to use the notification function to carry out notification. If you refuse to authorize, the notification service may not be available for you.
2.6. Auxiliary functions based on wireless data and WLAN: we need to access the Internet to provide searching, pushing, job browsing, resume sending and other necessary service. You need to authorize us to access the wireless data and WLAN of your device to access the Internet through your device so that our mobile client end can be connected to network to provide service for you. If you refuse to authorize, our mobile client end may not be available for you.
2.7. Auxiliary functions based on store: we need to use storage space and store permissions of your device to store various service data, user log, resume and relative information. If you refuse to authorize, the transmitting, browsing and download of relative information and material or our mobile client end may not be available for you.
For your use of the abovementioned functions, you need to give us accesses of your device on geographical location information, camera, photo album (picture gallery), microphone, mobile phone contacts, data and Internet accessing, store and other necessary permission to implement the function of information collection and usage. You can check the opening states of the abovementioned accesses or permissions term by term and decide to open or close them anytime (we will guide you to set them in your device system). Please be aware that your opening of the accesses will be deemed as that you authorize us to collect and use relative personal information to carry out the functions and your closing of the accesses will be deemed as your deauthorizing. We will cease to collect and use that information after your deauthorizing and, accordingly those functions will not be available for you. However, your deauthorizing will not affect any process of your personal information based on your previous authorization.
3. Situations in which we acquire your personal information from the third party
If you login and use our product and service via third-party account, or you authorize us to collect, acquire, process your personal information from the third party (such as to import your resume from third-party’s recruitment website), we may acquire your authorized account information (such as user icon, screen name, contacts) and resume, and bind your account with your third-party account or import your personal information form the third party into our database according to your consent and relevant instruction. We will check the legality of information source according to the agreement with the third party and use your personal information pursuant to the laws. If you refuse to provide this information or authorize, our product or service, or the demonstration of our product or service may not be available for you, but you may still use our basic browsing and searching service.
4. Principle of using your personal information
4.1. We will use your personal information for the purpose of carrying out functions of our product and service according to this Policy.
4.2. After collection of your personal information, we will de-identify the information by technology required by laws so that it cannot be used independently to identify the information subject. Please understand and accept that we have right to use the de-identified information. We have the right to analyze and use the information for commercial purpose, provided that we will not reveal your personal information.
4.3. Please be aware that we will be authorized to use your personal information continuously during the period of your use of our product or service unless you delete the information or refuse our collection by system setting. We will cease to use your personal information and delete or anonymize them as soon as possible while you close your account.
4.4. We will implement statistics on the use of our product and service, disclose the statistics to public or third party to show the using trend of our product and service. The statistics will not contain your identifiable information.
4.5. Unless we have your consent, when we demonstrate your personal information, we will desensitize it by means including content replacement or anonymization to protect it.
4.6. Before we process your personal information for unspecified use or unauthorized purpose beyond the scope of this Policy, we will ask for your prior consent by reminding you to check the dialog box and click on Confirm button.
5. You fully acknowledge that our collection and use of your personal information without your authorization are lawful to the extent that one of the following applies:
5.1. Collection and use are necessary for national security or national defense security;
5.2. Collection and use are necessary for public security, public health or vital public interests;
5.3. Collection and use are necessary for crime investigation, prosecution, trial, enforcement of the judgment;
5.4. Processing is necessary in order to protect the right of life or property and other vital interests of the information subject or another natural person but it is difficult to obtain their consent;
5.5. Collection relates to personal information which are manifestly made public by the information subject;
5.6. Collection relates to personal information which are lawfully made public, such as lawful news, open government information or another open source;
5.7. Collection and use are necessary for the entering into or performance of a contract according to your demand;
5.8. Collection and use are necessary for the safety and stability of our product or service, such as to find or correct the fault of our product or service;
5.9. Collection and use are necessary for the lawful news report;
5.10. Process is necessary for the statistical or academic research for the public interest purposes provided that personal information contained in disclosed research result are de-identified;
5.11. Other situations stipulated by laws and regulations.

COOKIE AND HOW WE USE COOKIE AND SIMILAR TECHNOLOGIES

1. Cookie
To ensure the website and client end are available, we will store a simple data file named Cookie in your computers or mobile devices. Cookies usually contains identifiers, websites name, numbers and characters. Our website may note your preference data by Cookie.
We will not use Cookie for any purpose except as stated in this Policy. You can control or delete Cookie as you wish. You can clear all the Cookies in your computer, or block Cookies by technical means provided by most of web browsers, but if you do so, you have to change your user settings every time you access to our website.

If you enable the Do Not Track function, our website will work as your choice.

HOW WE ENTRUSTING OTHERS TO PROCESS, SHARE, TRANSFER AND DISCLOSE YOUR PERSONAL INFORMATION

1. Entrusting
For more perfected and high quality product/services, some function may will provided by our partners (such as our third-parties supplier, contactor and agencies etc.), we will entrust our partners to process your personal information on our behalf, such as sending email, push notifications or sending survey invitation. We will binding confidential contract or data processing contract with the entrusted entities, organizations and persons to identify the duty, scop and purposes etc. in which we will bind them to process your personal information comply our requirement, this policy and relevant confidential security measures. We will not share your personal information with any company, organization or person other than MoSeeker, except for the following situation:
2.1. Sharing upon express consent: we will share your personal information with other person upon your express consent.
2.2. We will share your personal information when the information is duly required to be shared by applicable laws or regulatory authority.
2.3 We will share your personal information to the extent that one of the following applies:
(i) To the extent permitted by applicable law, sharing is necessary in order to protect the public interest, property right or security of MoSeeker, Affiliates, partners, you or other users against damage;
(ii) The core functions of our product and service or certain service you requesting cannot be carried out without sharing of your personal information;
(iii) Sharing is necessary in order to settle disputes between your and other parties for your request;
(iv) Sharing is pursuant to a contract or other legal document agreed by you (including electronic contract and platform rules confirmed online);
(v) Sharing is necessary for the purpose of academic research.
2.4.Sharing with our Affiliates: we may share your personal information with our Affiliates. We will not share more information than necessary and the sharing will be subject to the purpose specified in this Policy. If our affiliates intend to change the processing purpose, we will ask for your authorization again.
2.5.Sharing with our partners: some of our service may be provided by MoSeeker’s partners for purpose stated in this Policy. We may share your personal information with those partners to improve our service and customer experience. Our sharing will be limited to necessary information and subject to legitimate, proper, necessary, specified and explicit purposes. Our partners are obligated not to use your personal information for other purposes.
Currently, our partner includes:
(i) Advertising or analysis service partner. We will not share your identity information (which can be used to identify or contact you, such as name or phone number, through this information one can connect to you or identify you) with these partners unless we have your consent. We may provide to them the information on their advertising coverage and effectiveness excluding your identity information or we may summary this information to make sure these partners will not identify you.
For example, we inform advertisers about their advertising effectiveness, how many users browsed their ads or installed their application after browsed the ads, or non-identifiable demographic information (such as “a 25-year -old man locates in Shanghai and likes Software Development”) to help them to know their clients or audiences provided that they agree to comply with our advertising rules.
(ii) Vendor, service supplier and another partner. We may provide relevant information to our commodity, technology and service supplier or other partners supporting us all over the world. They may provide us with technology infrastructure service, analysis or appraisal of our service mode and effectiveness, customer service, payment convenience, academic researching or investigation.
(iii) We will enter into confidentiality agreement with the company, organization or personal with whom we share your personal information and obligate them to process the personal information pursuant to our instruction, this Policy and other relevant confidentiality and security measures.
3. Transfer
We will not transfer your personal information to any company, organization or personal except for the following situations:
3.1. Transfer upon explicit content: We will transfer your personal information to third party upon your explicit content.
3.2. In the event of a merger, acquisition, bankrupting or liquidation involving transfer of your personal information, we will obligate the successors to comply with this Policy, or we will obligate them to ask for your new authorization.

When you communicate with other uses, create transactions or share your information, you can decide at your sole discretion for whom your contact information, communication content, shared content or other personal information are available. Once you find that your information, especially your password, is divulged, please contact our CSR immediately so that we can take relevant measures.

HOW WE PROTECT YOUR PERSONAL INFORMATION

1. We have adopted security measures consistent with professional standards to protect your personal information from unauthorized access, disclosure, use, alteration, destruction or loss. We will take any reasonable and feasible measures to protect your personal information. For example, we use SSL encryption to secure the data exchange (such as credit card information) between our service and your terminal device; HTTPS encryption is enabled when you browse our website; We use encryption technologies to ensure data confidentiality. We use trusted protection mechanism to avoid malicious attacks against the data, and deploy access control to ensure that no one except authorized personnel is allowed to access the information. We also provide security and personal information protection trainings for our employees to enhance their awareness of the significance of data security protection.

Our data security capabilities: We have an industry-leading data-centric data security management system around the data lifecycle, and we have passed the ISO270001:2013 certification system certified by the international authority certification institution SGS, so that to improve the security of the entire system from organizational construction, system design, personnel management, product technology and other aspects.
3. We will take any reasonable and practicable measures to avoid collecting irrelevant personal information. We will retain your personal information only for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law.
4. There is no guarantee that the Internet is absolutely security. We highly recommended that you should not use email or instant message or other similar means to send your personal information because they are unencrypted. Please use complex password to assist us protect your account.
5. We will update and publish the content of security risk report, security impact assessment report and security incident report termly.
6. There is no guarantee that the Internet is absolutely security but we attempt to ensure that the personal information you provide is appropriately protected. In the event that your personal information is accessed, disclosed, altered, or destroyed without authorization and your legitimate right and interest are damaged by breach of any of our physical, technical, or managerial safeguards due to our fault, we will assume the corresponding liability.
7. When the information security incident occurs, we will, pursuant to applicable laws, keep you posted on basic information, possible affection of the incident, measures we have taken or will take, suggestion for you to reduces the risk and our remedy for you. We will notify you by means including but not limited to email, letter, phone, pushing notification. In the event that we cannot contact each information subject separately, we will post notification by reasonable and efficient means.
We will report the settlement of the incident to the regulatory authority pursuant to the supervision requirement.
Notwithstanding the aforementioned measures, please be aware that even if we take any measures we can to strengthen the safeguard, there is no “Perfect Security Measures” in information networks because of the technical limitations and various possible malicious tools. You shall assume the liability as a result of your account or password divulging due to your fault.
8. Store of your personal information
8.1. Your information and material will be stored in the servers of MoSeeker or its affiliates and may be transferred to, accessed, stored and demonstrated in other country or region where the other users located or where MoSeeker collecting information or data.
8.2. Unless as otherwise stipulated by law, the minimum period for which your personal information will be retained is 12 months after your close of your account. We will delete or anonymize your personal information after the expiry of the statutory period or retaining period stated in this Policy pursuant to the applicable laws.
8.3. If we determine to terminate our service or operation, we will give a notice to you at least thirty (30) days in advance and delete or anonymize your personal information after our termination.

YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL INFORMATION

According to laws, regulations and standards of the People's Republic of China and general practices of other country or region, we provide safeguards for your rights with respect to your personal information as follows:
1. Access your personal information
You have right to access your personal information unless as otherwise stipulated by law. You can access your personal information by the following means:
1.1. Account information—you can enter MoSeeker platform to access and edit your personal data and payment information, change your password, add security information, close your account or carry out other operation.
1.2. Searching information—you can enter MoSeeker platform to access or delete your searching records, browse and edit your interests or manage other data.
1.3. Resume —you can enter MoSeeker platform to browse and delete your resume and resume sending records.
If you cannot access your personal information by the abovementioned links, you can contact us through the contact information we provided and we will reply you in thirty (30) days.
We will cooperate to satisfy your request of providing your other personal information in connection with your use of our product and service if the cost is reasonable and acceptable for us to do so. But we will charge you for your repetitious requests in a certain period.
2. Correct your personal information
If your information is fallacious, you can apply to correct the fallacious information by means stated in “Article 1 Access Your Personal Information” of Section 6 of this Policy.
If you cannot correct your personal information by the abovementioned means, you can contact us at 4001018049 or send email to ask@moseeker.net and we will reply you in thirty(30) days.
3. Delete your personal information
You can ask us to delete your personal information to the extent that one of the following applies:
3.1. Our processing violates applicable laws;
3.2. We collect and use your personal information without your consent or authorization;
3.3. Our processing breaches the contract between you and us;
3.4. You cease to use our product or service, or you close your account;
3.5. We do not provide our product or service to you anymore.
It may be difficult for us to delete your personal information from our backups immediately after you delete it from our service but we will delete or anonymize it from our backups once the backups update. Additionally, please be aware that the information you have shared with others may be copied by them and will remain visible after you closed your account or deleted the information from your profile.
4. Change your authorization
Each of our functions bases on some of your personal information (Please refer to Section 1 of this Policy). You can give or cancel your authorization on collection or use of extra information anytime.
You can cancel your authorization via our platform.
We will not process your personal information after your cancel of authorization.
If you do not want to receive ads or the other message from our platform, you can inform us.
5. Close your account
You can contact us to close your account anytime.
Unless as otherwise stipulated by law, we will cease to provide our product or service to you and delete or anonymize your personal information according to the contract between you and us after you close your account.
We must notice, please deliberately close your account. The closure of the account will affect your use of MoSeeker Platform or cause inconvenience in using it, and it is unconvertible. Please back up your information and data before you engage closure. We will not be responsible for any adverse effect caused by your application of closure.
6. Restrain system intelligent recommendation
We may provide relevant service only based on automated service mechanism including information system and algorithms in relevant functions. If these automated services significantly affect your legitimate rights and interests, you have right to request us for explanation and we will also provide appropriate solutions.
7. Obtain duplicate of your personal information
You can obtain duplicate of your personal information by yourself by the means of signing in personal center.
We will cooperate to satisfy your request to transfer the duplicate to third party designated by you, provided that relevant technical condition is available (for example, the API is matching) and the cost is reasonable and acceptable for us to do so.
8. Respond to your abovementioned request
For the purpose of safeguard, you need to provide written apply or certify your identity by other ways. We will respond to you after the user authentication.
We will reply you in thirty (30) days. If we have not addressed your request to your satisfaction, you can contact the Cyberspace Administration, Communications Administration, Bureau of Public Security and Administration for Market Regulation to file a complaint.
Usually, we will not charge you for your reasonable request but we will charge for your repetitious or unreasonable requests upon our cost. We may refuse your requests to the extent that need unprovoked duplication, undue technology measures including developing new systems or interface or essentially changing the existing practices, or the requests that pose risk to the legal rights of others or are highly impractical for example involving information stored on backup tapes.
According to applicable laws, we cannot respond to your request to the extent that one of the following applies:
8.1. Refusing is necessary for national security or national defense security;
8.2. Refusing is necessary for public security, public health or vital public interests;;
8.3. Refusing is necessary for crime investigation, prosecution, trial, enforcement of the judgment;
8.4. It is indicated by sufficient evidence that your act is malicious or abusing of your rights;
8.5. If we respond, legitimate rights and interests of other person or organization will be damaged seriously;
8.6.Refusing is necessary for protection of business secret;
8.7. Other situations stipulated by laws.

HOW WE PROCESS PERSONAL INFORMATION OF MINORS

1. Our product, website and service are not for minors. Minors are not permitted to create their own user account without the consent of their parents or guardians.

In the case of collection of minors’ personal information under the consent of their parents or guardians, we will use and disclose their personal information only in situation that the use and disclosure are lawful or agreed explicitly by their parents or guardians or necessary for minor-protection.

Since the recruiting companies we serve may use our product or service via their resources and network servers all over the world, so that upon your authorization, all the information you provide may be transferred to or accessed by the request from the regions where our product or services have been used.
To the extent that the regions abovementioned may be governed by different data protection laws or have no relevant legislation, we will use commercially reasonable efforts to ensure that the protection of your personal information is equivalent to the standard in the People's Republic of China. We will request your permission to transfer your personal information across borders or to implement security measures such as data de-identification before cross-border data transfers.

THE SCOPE OF APPLICATION

1. All of our services, except for certain services, are subject to this policy. REVISION OF THIS POLICY

This Policy may be changed time to time.
We will not impair your right under this Policy without your explicit consent. We will post any change of this Policy on our platform.
When we make a material change to this Policy, we will implement significant notice (for some services we will send notices through MoSeeker’s platform) to explain the content of change.
A material change under this Policy is including but not limited to the following situations:
1. Major changes of our service mode include the purpose of processing, type or usage of personal information;
2. Major changes of our ownership, corporation structure and other matters include ownership change as a result of business adjustment, bankruptcy, mergers and acquisitions;
3. Changes of party to whom we entrust others to process, share, transfer or disclose the personal information;
4. Major changes of your right and the ways to exercise your rights in connection with the processing of the personal information;
5. Changes of our responsible department in charge of personal information security, our contacts, and complaint channels.
6. Our personal information security impact assessment report indicates a high-risk level.
We will file the previous version of our personal information protection policy for your information.
