Overview and Scope of Application of the Qianxun Enterprise User Agreement

This section explains the scope of platforms to which the Enterprise User Agreement applies, its legal effect, the obligation to read it, and how consent is given.

Qianxun is operated by Shanghai Qianxun Network Technology Co., Ltd. (Qianxun MoSeeker).
This Agreement applies to the Qianxun recruitment website and related platforms such as the WeChat official account.
This Enterprise User Agreement has legal effect between registered users and Qianxun.
Enterprise users have the obligation to read and comply with the terms of this Agreement.
Acceptance of this Agreement via online confirmation or other means is deemed consent and binding.

Definition of Service Recipients

This section defines the scope of enterprise users for the Qianxun Enterprise Recruitment System services.

The Qianxun Enterprise Recruitment System is intended for use by recruiting entities.
Enterprise users refer to entities that post recruitment information on Qianxun.
Other types of users are not enterprise users as defined in this Agreement.

Services Provided by Qianxun to Enterprise Users

This section lists recruitment management-related functions provided by Qianxun and explains the right to change services.

Enterprises may use the job management service to post jobs and view recruitment status.
The recruitment management service supports querying job application status and resume information.
Paid enterprises may create a WeChat recruitment page and post jobs on the WeChat platform.
The data analysis service provides detailed data such as job views, submissions, and sharing.
In principle, new functions and services launched by Qianxun are subject to this Agreement and may be adjusted.

Enterprise User Registration and Account Management

This section stipulates how enterprise accounts are applied for, quantity limits, security responsibilities, and the evidentiary effect of electronic records.

Enterprise registration requires providing a contact person’s mobile number and completing mobile verification to generate an account.
One mobile number may apply for only one account, and one enterprise user may have only one account.
Enterprise users bear full responsibility for account and password security and may not transfer or lend them.
Actions performed on Qianxun after logging in with an enterprise account are deemed actions of the enterprise itself.
Electronic information records may serve as valid evidence for determining enterprise user actions.

Suspension, Interruption, and Termination of Enterprise User Eligibility

This section explains circumstances under which Qianxun may suspend or terminate services due to changes in legal status or violations.

If an enterprise is dissolved, merged, or its qualification ceases in accordance with law, this Agreement terminates automatically.
Qianxun may unilaterally suspend, interrupt, or terminate all or part of the services when necessary.
Violations such as posting false or illegal information may result in suspension or termination of services.
Changes to service eligibility do not affect the enterprise’s responsibilities during the period of use.

Enterprise User Information and Job Posting Rights

This section grants enterprises the right to manage company and job information on Qianxun, while reserving Qianxun’s right to handle inappropriate information.

Enterprises may modify information such as company logo, name, industry, size, address, and profile.
Enterprises may set contact name, mobile number, email, bound WeChat, password, and other information.
Enterprises may post job information on Qianxun for registered users and visitors to browse.
No one has the right to modify or delete information posted by others.
Qianxun has the right to modify or delete inappropriate information at its discretion.

Enterprise User Eligibility and Lawful Use Obligations

This section specifies the legal qualifications enterprise users must have, limits use to recruitment purposes, and lists prohibited conduct.

Enterprise users must be organizations legally established under Chinese law and with full civil capacity.
Enterprises may post recruitment information and browse job seeker resumes only for recruitment purposes.
Qianxun and information obtained from it may not be used for non-recruitment purposes.
Qianxun may terminate services to enterprises that do not meet eligibility requirements at any time and require compensation for losses.
The Agreement lists multiple prohibited acts, including false information and illegal transfer of data.

Prohibited Illegal or Infringing Conduct by Enterprise Users and Liability

This section lists illegal, infringing, or platform-disrupting acts that enterprises may not carry out via Qianxun and clarifies legal liability.

Enterprises may not use Qianxun to infringe others’ lawful rights or engage in illegal acts.
Enterprises bear full legal responsibility for infringing acts carried out via the platform.
Enterprises may not interfere with devices, software, or programs for Qianxun’s normal operation.
Unauthorized access, scanning, or acts that compromise system security are prohibited.

Enterprise User Breach Liability and Qianxun’s Enforcement Rights

This section explains Qianxun’s enforcement rights when an enterprise breaches the Agreement and the enterprise’s compensation liability.

If an enterprise violates specific terms, Qianxun may unilaterally suspend, interrupt, or terminate services.
Qianxun may take the above measures without prior notice.
Enterprises must bear legal liability for infringing acts during use of the services.
Enterprises shall compensate the injured party and reimburse Qianxun in an equal amount for liabilities it has assumed in advance.

Privacy Protection for Enterprise User Information and Exceptions to Disclosure

This section explains Qianxun’s principles for protecting enterprise information and exceptions for disclosure under specific circumstances.

Qianxun uses industry-standard practices to protect the security of enterprise user information.
Without the enterprise’s consent, Qianxun will not sell or share information with third parties for free.
Qianxun may disclose relevant information when urgently safeguarding users’ and the public’s rights and interests.
Providing information to government authorities in accordance with law is one of the disclosure exceptions.
Enterprise and contact information may be disclosed in cases of assignment of rights/obligations, user consent, or as agreed in this Agreement.

Enterprise User Authorization for Qianxun to Analyze and Use Data

This section explains that enterprises authorize Qianxun to collect and analyze data without disclosing complete individual information.

Qianxun may collect relevant data without disclosing complete information of any single enterprise.
Qianxun may perform statistics, aggregation, and analysis on enterprise user data.
Analysis results may be used for information statistics and customer information push notifications, among other purposes.
Use of the services by the enterprise is deemed to grant the above authorization for data analysis and use.

Multi-Device Login and Authorization for WeChat Public Information

This section explains how enterprises log in to Qianxun via the website and WeChat, and the authorized use of WeChat public information.

After successful registration, enterprises may log in via the Qianxun recruitment website to use the services.
Enterprises may also log in to Qianxun services via the WeChat official account.
Qianxun may obtain public information on WeChat such as the enterprise and contact person’s public nickname and avatar.
Enterprises grant Qianxun a non-exclusive authorization to use the enterprise’s and contact person’s WeChat public information.
Enterprises shall ensure their WeChat contacts consent to the use of such public information.

Intellectual Property Protection of the Qianxun Platform and Content

This section defines the ownership of intellectual property in Qianxun website content and databases, enterprise use restrictions, and authorization for uploaded content.

All content on Qianxun is protected by intellectual property rights legally owned by Qianxun or other rights holders.
Without written consent, enterprises may not copy, modify, or commercially use Qianxun content without authorization.
With written permission and without modifying the content, it may be used for non-commercial purposes with the source indicated.
Content uploaded and published by enterprises is deemed to grant Qianxun a free, non-exclusive right of use.
For the purpose of providing services, Qianxun may copy, modify, and publish enterprise-uploaded content.

Liability for Third-Party Claims Arising from Content Posted by Enterprise Users

This section stipulates compensation liability when third-party claims arise due to content posted by enterprises on Qianxun.

Enterprise posting activities on Qianxun may give rise to third-party claims or damages.
All legal liability arising from the above acts shall be borne by the enterprise.
Enterprises shall fully compensate Qianxun for all losses caused by their acts.

Scope of Qianxun’s Liability and Disclaimer Clauses

This section defines Qianxun’s scope of liability and disclaimer circumstances in terms of information authenticity, account security, service interruption, and user-related causes.

Qianxun does not assume review or verification responsibility for information not published by itself.
Qianxun is not responsible for the authenticity and legality of job applicants’ and enterprises’ information.
Qianxun adopts industry practices to protect account security but does not guarantee absolute security.
Qianxun is not liable for service interruptions caused by hacker attacks, system maintenance, or force majeure.
Losses caused by the enterprise’s own reasons such as failure to follow rules or password leakage shall be borne by the enterprise.

Conditions for Agreement Effectiveness and Update Mechanism

This section explains the conditions under which the Agreement takes effect, Qianxun’s right to update it, and the enterprise’s options.

This Agreement is formed and becomes effective when the enterprise completes registration by filling in information and agreeing to the Agreement.
Actual use of the services by other permitted means is also deemed that the Agreement has taken effect.
Qianxun may update this Agreement at any time without separately notifying each user.
Any modifications to the Agreement constitute an inseparable part of this Agreement.
If the enterprise does not agree to the updated Agreement, it shall stop using the services; continued use is deemed acceptance.

Applicable Law Provisions

This section stipulates the laws applicable to the formation, validity, interpretation, performance, and dispute resolution of this Agreement.

The formation and effectiveness of this Agreement are governed by the laws of the People’s Republic of China.
The interpretation and performance of this Agreement are also governed by the laws of the People’s Republic of China.
The applicable law related to dispute resolution is likewise based on Chinese law.

Dispute Resolution Method and Jurisdiction Court

This section provides that disputes shall first be resolved through negotiation; if negotiation fails, they shall be adjudicated by a court with jurisdiction where Qianxun is located.

Disputes arising from this Agreement shall first be resolved through friendly negotiation.
If negotiation fails, a lawsuit may be filed with the people’s court with jurisdiction where Qianxun is located.
The court of jurisdiction shall be the court in the region where Qianxun MoSeeker is located.

Other Terms, Interpretation Rights, Assignment Rights, and Version Information

This section stipulates the effect of headings, severability, assignment of rights and obligations, interpretation rights, and the version release date.

Agreement headings and numbering are for reading convenience only and do not affect the meaning or validity of the terms.
If some terms are deemed invalid or unenforceable, the remaining terms remain valid.
Qianxun MoSeeker may assign the rights and obligations under this Agreement to its affiliates.
Qianxun MoSeeker reserves the final right of interpretation of this Agreement.
This Agreement version was released in June 2016.
